When selling products on Amazon Marketplace, you must ensure compliance with Regulation (EC) No 1907/2006 of the European Parliament and the Council concerning the Registration, Evaluation, Authorization, and Restriction of Chemicals (REACH). Under REACH regulations, if certain chemicals (such as heavy metals) in a product (i.e., a finished item) exceed the permitted limits, the product cannot be sold.
Annex XVII of the REACH Regulation outlines specific restrictions on cadmium, nickel, and lead in metal-containing products under Articles 23, 27, and 63:
1. Cadmium: Equal to or greater than 0.01% (by weight).
2. Nickel: Nickel release rate must not exceed 0.2 µg/cm² per week (migration limit).
3. Lead: Equal to or greater than 0.05% by weight.
Amazon accepts two types of compliance documents to approve or reinstate your ASIN:
1. REACH Compliance Declaration
- This document is a declaration drafted by the manufacturer confirming compliance with REACH requirements.
- The declaration should also mention any Substances of Very High Concern (SVHC) contained in the product.
- The REACH Compliance Declaration can be self-certified by the manufacturer or issued by a third-party testing agency.
2. REACH Heavy Metal Test Report
- This test report must confirm that all product components comply with REACH's heavy metal threshold limits.
- If your product fails Amazon’s or market regulators' physical inspections, a REACH test report will be required.
To comply with applicable laws and regulations, Amazon prohibits the sale of products that exceed the restriction levels specified in Annex XVII.
For certain products, Amazon requires manufacturers to provide a REACH declaration or test report demonstrating compliance with cadmium, nickel, and lead content limits. These products include:
1. Jewelry and imitation jewelry worn on the wrist and ankle, such as bracelets and anklets.
2. Jewelry and imitation jewelry worn around the neck, such as necklaces.
3. Jewelry and imitation jewelry used for body piercings, such as earrings and piercings.
4. Jewelry and imitation jewelry worn on fingers and toes, such as rings and toe rings.
Additionally, Amazon or market regulators may conduct physical inspections of products, which may require further documentation or even lead to sales suspension. To avoid disruptions, ensure that all compliance documents are prepared for all your products.
If your ASIN belongs to the categories mentioned above or has undergone physical testing, additional documents will be required. You will receive an email with detailed instructions.
