As is well known, children's products are subject to stringent regulations by various countries' laws. Any potential non-compliance can lead to recalls, inspections, product removals, and market penalties.

 

To ensure the safety and compliance of children's products, the TEMU platform has strict quality inspection standards for products sold to the U.S. and European markets.

 

When listing children's toys on the TEMU platform, obtaining the proper certifications is crucial for legal sales. What are TEMU's certification requirements for children's toys?

1. EU CE certification

The "CE" mark is a mandatory certification mark in the EU market. Products must bear the "CE" mark to be freely sold within the EU, regardless of whether they are produced in the EU or imported.

 

Toy CE certification must comply with the Toy Safety Directive 2009/48/EC and EN71-1, 2, 3 standards, which include:

- EN71-1: Mechanical and physical properties

- EN71-2: Flammability

- EN71-3: Migration of certain elements (chemical testing)

Electric toys must also comply with EN62115.

Additionally, all products requiring the CE or UKCA marks must provide the information of the Authorized Representative (AR) or the UK Responsible Person. The labeling must be complete, clear, and durable.

 

2. US CPC Certification

Children's toys must provide a Children's Product Certificate (CPC) in compliance with the U.S. Consumer Product Safety Improvement Act (CPSIA). The CPC must be based on test results from a third-party laboratory recognized by the U.S. Consumer Product Safety Commission (CPSC).

 

From the moment of listing, CPC certification must be uploaded. TEMU will increase the inspection frequency of CPC certifications and requires a "Children's Product Certificate" to prove compliance.

For certain products in the U.S., besides the regulations met for CPC, products intended for children under 12 must also comply with the tracking label requirements. The tracking label must be on both the packaging and the product (unless exempted). Lack of a tracking label may lead to customs detention.

 

3. Label Content Compliance

Sellers on the TEMU platform must strictly adhere to packaging label regulations. Labels must be attached to the product packaging, and physical photos of the labels must be uploaded to the compliance center.

 

Definition of children's toys: Any product designed or clearly intended for children under 14, according to the target market's age regulations (including but not limited to figurine toys, cartoon decorations, etc.).

 

Required label items include:

1. Product name/model

2. Manufacturer's name

3. Manufacturer's address

4. Country of origin (e.g., Made in China)

5. Production date/batch number

6. Age identification

7. Warning instructions (e.g., small parts warning, marbles warning, small balls warning, plastic bag suffocation hazard)

8. CE Marking and other required markings for the target sales market

9. Contact information for the overseas representative (EU AR/UK RP): Company name, address

For electronic toys, the applicable regulations for electronic and electrical products must also be met.

 

4. Warning Information

Products must include industry-standard barcodes and full-English care labels, along with warning labels in 10 languages. Non-compliant labels will be rejected by the warehouse and must be updated and reapplied before shipment.

 

Plastic packaging must clearly state the applicable age range and any necessary warning information, such as choking hazard warnings. These warnings should be in the official language of the target sales country.

 

In the U.S., warnings must include:

1. A warning symbol (an equilateral triangle with an exclamation mark, the height of which is at least equal to the height of the text), an information word (Caution or Warning, font height ≥ 1/8 inch or about 3.2 mm), and a hazard description (font height ≥ 1/16 inch or about 1.6 mm).

2. Choking hazard warnings must be on the main view of the product if applicable.

In the EU, warnings must be in the official language of the target sales country, consisting of an information word (Warning or Warnings) and a hazard description.

 

Examples of choking hazard warnings according to U.S. toy standards (in English only) include:

1. Warning for toys not suitable for children under 3 years due to small parts choking hazard.

Sellers must create labels according to platform requirements, ensure compliance, and only ship after passing system checks.

 

European Union:

1. Toys not suitable for children under 36 months – due to functional, dimensional, characteristic/nature, or other compelling reasons (Warning: Not suitable for children under 36 months / 3 years).

2. Activity toys/playground equipment (Warning: For domestic use only).

4. Chemical toys (Warning: Not suitable for children under (*) years. To be used under adult supervision).  

   Note: The minimum applicable age should be filled in the parentheses.

 

5. Children's roller skates, inline skates, rollerblades, skateboards, scooters, and bicycles (Warning: Protective equipment should be worn. Not to be used in traffic).

 

6. Toys intended for use in water (Warning: To be used only where the child is within its depth and under adult supervision).

 

7. Toys in food (Warning: Contains a toy. Adult supervision recommended).

 

8. Toys that imitate protective masks and helmets (Warning: This toy does not provide protection).

9. Toys intended to be strung across a crib, playpen, or perambulator by means of string, cords, or straps (Warning: To prevent possible injury by entanglement, remove this toy when the child begins to push up on hands and knees).

10. Packaging for olfactory board games, cosmetic kits, and gustative games (Warning: Contains fragrances that may cause allergies).
