Recently, TEMU platform issued a notification emphasizing not only the strengthening of FCC certification qualifications for products sold to the U.S. market but also compliance control for FCC instruction manuals. For non-compliant products, TEMU will take measures including but not limited to actively responding to regulatory requirements, issuing risk warnings to buyers, removing products, and notifying buyers or other relevant parties to destroy/return products. FCC stands for the Federal Communications Commission, a U.S. government independent agency established in 1934 and directly responsible to Congress. According to the U.S. Code of Federal Regulations (CFR 47), most electronic products entering the U.S. market must undergo FCC certification to ensure compliance in wireless communication. This mandatory certification applies to nearly all electronic devices, ensuring they meet U.S. regulations and standards in electromagnetic compatibility, wireless spectrum use, and wireless communication performance to ensure public safety and the effective operation of wireless communication.
FCC certification is required for all radio equipment and other electronic products sold or supplied to the U.S. market, including but not limited to:
- Power Supplies: Communication power, switching power supplies, adapters, wireless chargers, chargers, display power supplies, LED power supplies, LCD power supplies, UPS systems, etc.
- Lighting: Ceiling lights, wall lights, pendant lights, track lights, portable lights, street lights, light strings, desk lamps, grille lights, aquarium lights, energy-saving lamps, LED lights, T8 tubes, etc.
- Home Appliances: Refrigerators, washing machines, fans, air conditioners, humidifiers, air purifiers, vacuum cleaners, range hoods, ovens, sterilizers, integrated stoves, water heaters, water purifiers, rice cookers, hair dryers, facial cleansers, massage chairs, scales, etc.
- Electronics: TVs, sound systems, DVD players, projectors, cameras, monitors, computers, printers, headphones, mice, keyboards, routers, laser pointers, etc.
- Communication Products: Telephones, fax machines, answering machines, data modems, data interface cards, and other communication products.
- Wireless Products: Tablets, wireless keyboards, wireless mice, walkie-talkies, wireless microphones, remote controls, wireless video transmission systems, and other low-power wireless products.
- Wireless Communication Products: Mobile phones, network cards, DECT phones (1.8G, 1.9G frequencies), etc.
- Machinery: Gasoline engines, welding machines, CNC drilling machines, tool grinders, lawn mowers, cleaning equipment, bulldozers, lifts, drilling machines, water treatment equipment, gasoline welding machines, printing machinery, etc.
- Supplier Requirements: TEMU requires all products sold to obtain FCC certification first. Suppliers must provide an FCC certificate as a sales qualification.
- Entry Review Requirements: TEMU will check FCC certification qualifications during the onboarding review of new suppliers. Products without FCC certification cannot be sold on the TEMU e-commerce platform.
- Ongoing Supervision: TEMU will periodically inspect the FCC certification status of products. If issues are found, suppliers will be required to rectify them immediately.
FCC certification ensures that products comply with U.S. regulations and standards for radio frequencies and electromagnetic compatibility. Merchants need to test products accordingly and follow FCC application procedures and labeling requirements.
- FCC ID Label: The FCC requires manufacturers of products emitting RF energy to place an FCC ID label on the device. It can be affixed to the product, etched on the exterior, or displayed electronically. The FCC ID must be clearly visible and use a legible font.
- Notice: The prefix for the FCC ID must be uppercase "FCC ID." Formats such as "FCCID," "FCC IDENTIFIRE," "FCC-ID," "Fcc ID," or "FCC id" are unacceptable.
The FCC mandates that all products authorized with FCC SDoC or FCC certification must include one of the following compliance statements:
1. Receivers Associated with Licensed Radio Services:
"This device complies with part 15 of the FCC Rules. Operation is subject to the condition that this device does not cause harmful interference."
2. Independent Cable Input Selector Switches:
"This device complies with part 15 of the FCC Rules for use with cable television service."
3. All Other Devices:
"This device complies with part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) This device may not cause harmful interference, and (2) this device must accept any interference received, including interference that may cause undesired operation."
All electronic products subject to FCC regulations must include "Information to User" in the manual, providing instructions such as:
1. Warning Users:
Changes or modifications not approved by the responsible party may void the user's authority to operate the equipment.
FCC Qualification Requirements
Sellers must provide appropriate qualification documents, including either FCC ID or FCC SDoC certifications:
1. FCC ID Certification:
Requires documentation that complies with 47 CFR FCC Part 15C standards and matching information on the FCC website.
2. FCC SDoC Certification:
Should include a certificate and corresponding test report, indicating compliance with FCC Part 15B regulations in the Federal Regulations (CFR).
- Applicable Products:
FCC SDoC applies to non-wireless products like humidifiers and fans, while FCC ID covers wireless devices such as smartphones.
- Testing Content:
FCC SDoC focuses on electromagnetic compatibility (EMC), while FCC ID includes EMC and RF testing.
- Costs and Timeframes:
FCC SDoC certification is less expensive and faster compared to FCC ID.
- U.S. Agent Information:
Starting in 2023, U.S. agent information is required for FCC-ID certification of wireless communication products.
- Factory Review:
Unlike other certifications, FCC certification only tests samples for safety and doesn't involve factory reviews.
- Validity Period:
FCC certification has no fixed expiration but may need renewal if standards change, significant product modifications occur, or safety issues arise.
Products sold on TEMU must comply with FCC requirements, including following relevant standards, completing necessary testing, and meeting labeling regulations.
