According to the recent FCC Order 22-84 and KDB 986446 issued by the Federal Communications Commission, starting from February 6, 2023, all FCC equipment authorizations—whether the applicant is a U.S. domestic or foreign company—must designate a U.S. contact point as a service agent for the FCC equipment authorization process. The agent will represent the applicant in submitting the application and related documents for the equipment authorization process. The service agent can be an individual or a company, but it cannot be a TCB (Telecommunications Certification Body) or an FCC-recognized laboratory, nor any affiliated individuals or companies. U.S. domestic companies may designate themselves as agents. The agent must hold a Federal Registration Number (FRN).
Applicants for FCC equipment authorization must provide a formal letter confirming the designation of a local U.S. agent. Each FCC equipment authorization case file must include a copy of the local agent’s authorization document.
- Signatures from both the applicant and the agent (if the agent and applicant are not the same company).
- Confirmation that the applicant agrees to authorize and designate the agent to accept the responsibility of receiving the authorization application.
- The agent's actual contact address, phone number, and email.
- The agent’s FRN.
- Confirmation that the applicant will maintain the agent’s authorization for at least one year after ceasing the marketing, importation, or any FCC-related procedures involving the equipment.
For products that enter the market or products that stop selling within one year, if the agent changes, the TCB must notify the FCC to set the relevant certificate to "Audit Mode" until the agent authorization letter in the certification file is updated.
