The purpose of Proposition 65, enacted in 1986, is to protect drinking water sources from contamination by chemicals known to cause cancer, birth defects, or other reproductive harm. Businesses operating in California must provide warnings to consumers if their products contain or expose users to any of the approximately 900 listed chemicals.
The list of harmful chemicals is extensive and frequently updated. Regardless of whether a product is already widely sold or newly launched, companies must verify compliance with legal requirements before entering the California market. Violations may result in civil penalties of up to $2,500 per violation per day.
Proposition 65 applies to all consumer products sold in the state of California.
